Publisher identification and site usage rules
These legal notices apply to the transactional website www.hapi-auto.ca. They supplement the General Terms and Conditions of Sale, the Privacy Policy and the other policies published on the site.

2. Publication manager
The publication manager is the presidency of HAPI AUTO AXION INC. Any request relating to the content of the site may be sent to contact@hapi-auto.ca.
3. Design, development and hosting

The initial technical hosting of the site is provided under the contract entered into with CyberPerformance. The hosting information may be updated if HAPI AUTO changes its provider or infrastructure.
4. Purpose of the site
The site presents and sells automotive accessories in Canada. It provides, in particular, product sheets, a search or compatibility tool, informational content, a shopping cart, a payment system, order tracking and means of communicating with customer service.
5. Access, availability and maintenance
HAPI AUTO implements reasonable means to make the site accessible and functional. Access may nevertheless be temporarily interrupted for maintenance, updates, security, a provider outage, a network incident or another reasonable circumstance.
HAPI AUTO does not guarantee that the site will be available without interruption or that it will be free of any technical error. When a problem is brought to its attention, HAPI AUTO takes reasonable measures to correct it or limit its effects.
6. Product information and vehicle compatibility
Descriptions, dimensions, images, colours, references and compatibility indications are prepared with care. Slight variations may nevertheless result from the screen, the manufacturer, a product update or the vehicle version.
The customer must verify the information specific to their vehicle, including the year, make, model, trim, body type, powertrain and dimensions. The information provided on the site does not replace the advice of a professional when an installation affects a vehicle's safety, lighting, electrical, braking, restraint or control system.
7. Intellectual property
Unless otherwise indicated, HAPI AUTO owns or lawfully uses the rights relating to the structure of the site, the original texts, the graphic elements, the logo, the original photographs, the videos, the databases and the content created for the site.
Any reproduction, substantial extraction, adaptation, distribution, republication, sale or commercial exploitation of these elements is prohibited without prior written authorization, subject to the exceptions provided by law.
8. Third-party trademarks, images and content
Manufacturer names, trademarks, vehicle models, logos, photographs and descriptions belonging to third parties remain the property of their holders. Their presence on the site serves to identify, describe or make a product compatible and does not necessarily mean that HAPI AUTO is an authorized dealer or distributor of the brand concerned.
9. External links and third-party services
The site may contain links to carriers, manufacturers, payment providers, social networks, analytics tools or other third-party services. HAPI AUTO chooses its providers with care but does not control all of their content, policies or service interruptions.
An external link does not constitute a general endorsement. The user is invited to review the terms and policies of the third party when leaving the HAPI AUTO site.
10. Authorized use of the site
It is prohibited to use the site to commit fraud, impersonate an identity, transmit malicious code, circumvent a security measure, massively scrape the catalogue, automate abusive purchases, infringe the rights of others or disrupt the operation of the service.
HAPI AUTO may block suspicious or abusive activity, suspend an account and cooperate with the authorities when the law permits or requires it.
11. Reviews, photos and user-submitted content
A user who submits a review, a photograph or a comment confirms that they are authorized to do so, that the content is accurate and that it does not infringe the rights, privacy or reputation of others. HAPI AUTO may moderate or remove content that is illegal, fraudulent, hateful, defamatory, obscene, promotional or unrelated to the product.
12. Limitation and protection of consumer rights
The general information on the site is provided for informational purposes. No provision of these notices limits a warranty, a remedy or a liability that cannot legally be excluded, including the legal warranties applicable to consumer goods.
HAPI AUTO is not responsible for damage resulting exclusively from use contrary to the instructions, from unauthorized modification, from inaccurate information provided by the user or from improper installation, subject to the applicable mandatory rules.
13. Personal information and cookies
The collection, use, retention and disclosure of personal information are described in HAPI AUTO's Privacy Policy. Cookies and similar technologies are managed in accordance with the cookie policy and the preferences offered to the visitor.
Payment card information is processed by Stripe or another secure payment provider. HAPI AUTO does not directly retain the full card number when it is processed by the provider.
14. Applicable law, consumers and dispute resolution
These notices are governed by the laws applicable in the province of Québec and by the federal laws of Canada that apply thereto. A consumer residing in another province or territory retains the mandatory protections granted by the law of their place of residence.
Before initiating any proceedings, the user is invited to contact HAPI AUTO in order to seek a solution. This step imposes no mandatory arbitration, prohibits no class action and does not limit access to the courts recognized by law.
15. Language
The French version of the site, of the terms and of the related documents is made available in accordance with the laws applicable in Québec. An English version may be offered. Where the law requires it, the customer's express wish to contract in another language is obtained after they have had access to the French version.
16. Updating of the legal notices
HAPI AUTO may update these notices to reflect a change to its contact information, its providers, its services or the law. The date of the last update is indicated at the beginning of the document.
